Your Consumer Rights
Understanding your rights under Australian Consumer Law
Australian Consumer Law Protection
Pintio services are provided in compliance with the Australian Consumer Law (ACL). Your consumer rights under the ACL cannot be excluded, restricted, or modified by our terms and conditions.
What is Australian Consumer Law?
The Australian Consumer Law (ACL) is a national law that applies across Australia and provides protection for consumers. It sets out consumer rights and business obligations when buying or selling goods and services.
As a consumer using Pintio services, you are protected by the ACL regardless of where in Australia you are located or where our business is based.
Consumer Guarantees for Services
Under the ACL, when you purchase Pintio services, you automatically receive the following consumer guarantees:
Services must be provided with due care and skill using appropriate technical expertise and professional standards.
Services must be reasonably fit for the purpose we tell you they're for, or for any purpose you make known to us.
Services must be provided within a reasonable time, taking into account the nature and complexity of the service.
Services must match the description provided and any demonstrations or samples shown to you.
When Things Go Wrong
Major Problems
If there's a major problem with our service, you can choose to:
- Cancel the service and get a refund for the unused portion
- Keep the service and seek compensation for the reduced value
What constitutes a major problem?
- • The service has a problem that would have stopped a reasonable customer from buying it
- • The service is substantially unfit for its normal purpose and can't be easily fixed
- • The service doesn't meet a specific purpose you told us about and can't be easily fixed
- • The service creates an unsafe situation
Minor Problems
For minor problems, we must:
- Fix the problem within a reasonable time at no cost to you
- If we can't fix it within a reasonable time, you can cancel and get a refund or seek compensation
Your Rights Cannot Be Taken Away
Important: Your consumer guarantees apply even if:
- • You agreed to different terms in a contract
- • A sign or contract says "no refunds" or "warranties excluded"
- • You got the service at a discounted price or for free
- • You didn't read our terms and conditions
- • The business told you that consumer guarantees don't apply
What We Can't Avoid Responsibility For
We cannot exclude, restrict, or modify our liability for:
- Death or personal injury caused by our negligence
- Breach of consumer guarantees under the ACL
- Misleading or deceptive conduct
- Breach of conditions and warranties implied by law
When Consumer Guarantees Don't Apply
Consumer guarantees don't apply when:
- You use our service in a way that's not normal or that we advised against
- The problem is caused by something you did or failed to do
- You were told about the problem before you bought the service
- The problem was obvious or you could have discovered it through reasonable examination
